1. Introduction

 

These Terms and Conditions govern the services provided by Art Fly Learn & Cheshire Art Hub, owned and operated by Loren Somerville, a sole trader based in Chester, UK. By engaging with our services, purchasing products, or attending sessions, you agree to the following terms.

3. Services Provided

 

We provide the following services:

• Original artwork, prints, and commissions

• In-person and online art classes

• Tarot readings (both in-person and online)

 

4. Art Services

 

a) Products

 

• Turnaround Times: For prints, expect delivery within 7–21 days.

• Refunds: Items may be returned for a refund within 14 days, provided they are in pristine condition.

• Gift Vouchers: Expire 6 months from the date of issue.

 

b) Commissions

 

• Require a 25% deposit upon booking.

• Final payment is due upon completion.

 

5. Art Classes

 

a) Session Types

 

• Offered as group workshops or 1:1 sessions.

• Sessions are available through monthly memberships, individual bookings, or workshop vouchers.

 

b) Policies

 

• Cancellations/Rescheduling: Require at least 24 hours’ notice. Failing to notify within this timeframe results in a loss of credit.

• Monthly Memberships: Credits expire at the end of the month if unused.

• Workshop Vouchers: Expire 6 months from the date of issue.

 

c) Refunds

 

• Refunds are not available if a student:

• Fails to cancel or reschedule within 24 hours.

• Purchases a block of sessions and does not attend.

• Attends and uses the facilities.

 

d) Late Arrivals

 

• Latecomers are welcome but will only receive the remaining time of the session, with no extensions or replacements.

 

6. Tarot Readings

 

• Tarot readings are available in-person or online and may be conducted live or pre-recorded depending on the booking.

• Entertainment Purposes Only: Tarot readings are not a substitute for legal, medical, or professional advice.

• Refunds: Refunds will only be issued if:

• The reading cannot be provided for any reason.

• The deadline for the reading (within 7 days) is missed.

 

7. Payment Policies

 

• Accepted Payment Methods: Online payments, PayPal, American Express, and over-the-phone transactions (all PCI compliant).

• Upfront Payment:

• Tarot readings require full upfront payment.

• Art classes and workshops may be paid for individually or on the day at a premium price.

• Memberships must be paid in advance.

 

8. Intellectual Property

 

a) Artwork Usage

 

• Reproduction of any artwork is strictly prohibited without prior written consent.

 

b) Teaching Materials

 

• Teaching materials are subject to a £5 fair usage fee per session, with discretion to charge for excessive material use.

 

c) Content Sharing

 

• Clients may record or post tarot readings, artwork, or workspace imagery on social media provided Art Fly Learn is credited.

 

9. Client Conduct and Responsibilities

 

• Respectful Behavior: Clients are expected to respect the space, materials, staff, and other attendees. Failure to do so may result in removal from the premises.

• Age Restrictions: Tarot readings for clients under 18 require parental/guardian consent.

 

10. Safety and Limitations

 

• Art Classes: Clients attend sessions at their own risk. Cheshire Art Hub is not liable for any injuries or accidents that may occur during participation.

• Result Disclaimer: No guarantees are provided regarding outcomes of art lessons or tarot readings.

 

11. Privacy and Marketing Consent

 

• All transactions are PCI compliant.

• By attending sessions, clients consent to their artwork, photographs, or videos being used for marketing purposes across social media and the website.

 

12. Booking and Cancellation Policies

 

• Cancellation/Rescheduling: Require 24 hours’ notice. Late cancellations or no-shows result in a loss of credit.

• Right to Amend: We reserve the right to reschedule or cancel sessions at any time.

 

13. Jurisdiction

 

These Terms and Conditions are governed by the laws of England and Wales.

 

14. Force Majeure

 

We are not liable for cancellations or delays caused by events beyond our control, such as extreme weather, technical issues, or unforeseen circumstances.
